Welcome to The Everlasting Image. These Terms & Conditions outline the terms that apply when you inquire about, book, or use our photo booth services. By submitting a booking request, signing an agreement, or making a payment, you agree to these terms.
A date is not considered officially reserved until The Everlasting Image has received the required booking payment and any required booking information or agreement has been completed.
Availability is not guaranteed until the booking has been confirmed by The Everlasting Image.
The person making the booking is responsible for providing accurate event information, including the event date, venue, address, start time, end time, and any other information necessary for us to provide our services.
Payment is required in full at the time of booking through our website. Your selected package, event date, and services are confirmed once payment has been successfully received.
All prices shown on our website are subject to any applicable taxes, travel fees, or additional services selected during checkout.
By completing your purchase, you agree to the package, services, event date, and cancellation and refund terms outlined in these Terms & Conditions.
We understand that plans can change. Because your booking reserves a specific date and time exclusively for your event, cancellations made closer to the event date may be subject to a cancellation fee.
Our refund policy is as follows:
Refunds will be issued to the original payment method used for the booking.
Any applicable processing fees charged by third-party payment providers may be non-refundable.
If you need to cancel your booking, please contact The Everlasting Image as soon as possible. The cancellation date will be based on the date we receive your written cancellation request.
We understand that circumstances can change, and we will do our best to accommodate requests to move your event to a new date.
Rescheduling requests made 30 or more days before the original event date may be transferred to a new available date at no additional charge.
Requests made less than 30 days before the event are subject to our availability and may be subject to a rescheduling fee.
If we are unable to accommodate your requested new date, the applicable cancellation and refund policy will apply.
A booking may only be rescheduled once unless otherwise approved by The Everlasting Image.
The client is responsible for providing The Everlasting Image with reasonable access to the event venue for setup and teardown.
Our standard setup time is included in your package unless otherwise specified.
The client or venue must provide:
If the venue does not allow sufficient setup time or access, The Everlasting Image cannot guarantee that the booth will be ready at the scheduled start time.
Your package time begins at the scheduled service start time, regardless of whether guests arrive late.
If the event or guests are delayed, the unused portion of the rental period will generally not be added to the end of the event.
If The Everlasting Image is delayed due to circumstances within our reasonable control, we will make reasonable efforts to provide the full contracted service time whenever possible.
Additional time may be available if requested and if our schedule permits.
Additional hours are currently available at $150 per hour, unless otherwise stated in your booking agreement.
Overtime must be approved by The Everlasting Image before additional service time is provided.
Our standard pricing may include travel within our designated service area.
Events outside of our standard service area may be subject to an additional travel or mileage fee. Any applicable travel fees will be communicated before the booking is finalized.
The client agrees to take reasonable care of The Everlasting Image's equipment, props, backdrops, printer, camera equipment, and other property while it is at the event.
The client may be responsible for the cost of repair or replacement for damage caused by intentional misuse, reckless behavior, or negligence by the client, guests, venue, or other individuals associated with the event.
Guests are not permitted to move, unplug, alter, or operate equipment outside of its intended use.
The Everlasting Image reserves the right to stop service or remove an individual from the photo booth area if that person's behavior creates a safety risk, damages equipment, or significantly interferes with our ability to provide services.
No refund will be provided for service interruptions caused by inappropriate, dangerous, or destructive guest behavior.
Photo booth photographs are provided according to the services included in the selected package.
Digital photographs may be delivered through an online gallery, digital sharing system, or another method selected by The Everlasting Image.
Gallery availability and storage periods may vary. Clients are responsible for downloading and saving their photographs during the period in which the gallery is available.
The Everlasting Image is not responsible for permanently lost photographs after the applicable gallery or storage period has ended.
The Everlasting Image respects the privacy of our clients and guests.
We will not intentionally use photographs from your event for advertising, social media, website galleries, or other promotional purposes without appropriate permission or authorization.
If promotional use is requested or authorized, the applicable consent or release will be handled separately.
For outdoor events, the client is responsible for providing an appropriate, safe, and protected area for the photo booth and equipment.
The equipment must be protected from rain, excessive heat, direct sunlight, strong winds, moisture, and other conditions that could damage the equipment or create an unsafe environment.
If weather conditions make it unsafe to operate the photo booth, The Everlasting Image may temporarily suspend service or require the booth to be moved to a safe location.
The client is responsible for having an appropriate indoor or covered backup location when necessary.
The client is responsible for communicating any venue-specific requirements to The Everlasting Image before the event.
Unless otherwise agreed upon, the venue must provide access to a suitable electrical outlet and an appropriate setup area.
The Everlasting Image is not responsible for delays or interruptions caused by venue restrictions, power outages, inadequate electrical access, or other venue-related circumstances outside of our control.
We make every reasonable effort to ensure our equipment is properly maintained and functioning before each event.
In the unlikely event of an equipment malfunction, we will make reasonable efforts to repair, replace, or troubleshoot the equipment and continue providing services.
If we are unable to provide the contracted service due to a significant equipment failure or other issue within our control, any refund or credit will be determined based on the portion of services that could not be provided.
The Everlasting Image will not be held responsible for failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, fire, power outages, government restrictions, venue closures, transportation emergencies, or other unforeseen circumstances.
We will make reasonable efforts to work with the client to reschedule the event when possible.
Any changes to the package, event time, venue, backdrop, add-ons, or other services must be approved by The Everlasting Image.
Additional charges may apply to requested changes.
The client is responsible for providing accurate event information and ensuring that The Everlasting Image has the information and access necessary to perform the contracted services.
The client is also responsible for communicating any venue rules, restrictions, parking requirements, loading instructions, or special circumstances that may affect our services.
The Everlasting Image will make reasonable efforts to provide professional and reliable services.
To the extent permitted by applicable law, The Everlasting Image will not be responsible for indirect, incidental, or consequential losses arising from circumstances beyond our reasonable control.
Our liability for services that cannot be provided will generally be limited to the amount paid for the affected services, except where otherwise required by law.
By booking The Everlasting Image, submitting payment, or using our services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
These terms may be supplemented by a separate booking agreement or invoice containing additional event-specific terms. If there is a conflict between these Terms & Conditions and a signed booking agreement, the terms of the signed booking agreement will control for that specific event.
